Court Order Postpones Implementation of Regulation Ending "Duration of Status"
On Monday, September 14, the U.S. District Court for the District of Massachusetts issued a preliminary injunction postponing the implementation of the new regulation that was scheduled to take effect on Tuesday, September 15. This court order means that the new regulation cannot go into effect until there is further action by the court. All existing F-1 and J-1 regulations and procedures continue to follow the standard regulations that have been in place, and there are no changes at this time to “Duration of Status” or other academic limitations included in the new rule.
It is important to note that the final rule has not been permanently invalidated. There is a possibility that future court orders could reverse this decision and cause the final rule to be implemented very quickly. International students and scholars who are making decisions about travel, extension applications, academic changes, or work authorization applications should consult with an ISSS advisor for the most current and accurate information.
ISSS is continuing to monitor this situation very closely. We will provide additional updates via our listserv and the ISSS website about any future developments related to this regulation.
Duration of Status Final Rule Update
On July 17, 2026, the U.S. Department of Homeland Security (DHS) finalized a rule eliminating Duration of Status (D/S) for F and J students. ISSS is will continue to share updates and guidance as additional information becomes available.
We realize that significant changes in F and J immigration regulations can be overwhelming and may lead to many questions and concerns about your personal circumstances. As this rule change shift is occurring, please know you are not navigating this alone. Your ISSS team is working closely with SUNY and our professional organizations in order to provide clear and accurate guidance. Finally, please remember to monitor your SUNY Oswego email for messages from the ISSS office with information and important updates.
The ISSS office hours are Monday from 10 am to 12 pm and Tuesday, Wednesday and Thursday from 2:30 pm to 4 pm. For summer hours the office is closed on Fridays through August 7, 2026.
